Terms of Service

These terms govern your use of this website, operated by Elias de Sena, trading as Newton Studios, Bützenstrasse 17, 8185 Winkel, Schweiz ("we", "us"). By using the site you agree to them. If you do not agree, do not use the site.

1. What we do

Newton Studios is a studio that provides consulting and creative services to businesses: offer positioning, rebranding, web design and development, and business and marketing automation. This website describes those services and lets you get in touch. It sells nothing directly — no orders are placed and no payments are taken on the site.

2. Engagements are separate contracts

Client work is governed by an individual engagement agreement — a signed proposal or statement of work covering scope, deliverables, fees, timeline, and intellectual property for that project. Nothing on this website is an offer capable of acceptance, and nothing here becomes part of an engagement unless the engagement agreement says so. If these terms and a signed engagement agreement conflict, the engagement agreement wins.

3. Enquiries

Submitting the contact form or booking a call creates no obligation on either side. It is a conversation, not a contract. We reply to enquiries within a reasonable time, and an engagement begins only when both sides sign the engagement agreement. How we handle the personal data you send us is described in our Privacy Policy.

4. Website content

• Content on this site is general information about our services, not professional advice for your specific situation. Decisions you make based on it are your own.
• Where the site shows sample figures or illustrative outcomes, they are marked as such on the page. They describe what an engagement is designed to change, not a promise of what yours will achieve — results depend on the business, the market, and the work.
• We may change, move, or remove site content at any time without notice.

5. Intellectual property

The website, its design, and its content belong to us or our licensors. You may read, link to, and share it; you may not copy the site, scrape it at scale, or pass its content off as your own. Client project IP is dealt with in each engagement agreement, not here.

6. Acceptable use

Do not abuse, overload, probe, or attempt to gain unauthorised access to the site or its infrastructure, and do not use the contact form to send spam or unlawful content. We may block traffic that does.

7. Our liability for the website

The website is provided "as is", without warranties of any kind, including that it will be uninterrupted or error-free. To the extent the applicable law allows, we are not liable for damages arising from your use of the website itself. Liability under an engagement is governed by that engagement's agreement. Nothing here excludes liability that cannot lawfully be excluded, including for intent or gross negligence.

8. Changes to these terms

We may update these terms. The version in force is the one published here, per the "last updated" date above. Changes apply from that date forward and are never retroactive.

9. Governing law

These terms are governed by Swiss law; the place of jurisdiction is Zürich, Switzerland, unless mandatory consumer-protection rules of your country of residence provide otherwise. If any provision is found unenforceable, the rest remains in force.
